In order to further strengthen the management of natural resource assets in our province and improve the property rights system of natural resource assets, this implementation plan is formulated in accordance with the spirit of the Notice issued by the General Office of the Central Committee of the Communist Party of China and The General Office of the State Council on Guiding Opinions on Coordinating and Promoting the Reform of the Property Rights System of Natural Resource Assets and the actual situation of our province。

I. General requirements

　　Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era，We will thoroughly implement the guiding principles of the 19th CPC National Congress and the second, third, fourth, and Fifth Central Congresses of the 19th CPC National Congress，We will accelerate the improvement of the property rights system for natural resources，Clarify the subject of property rights of natural resource assets，We will promote the investigation, monitoring and registration of natural resources，We will build a natural resource asset property rights system with clear ownership, clear rights and responsibilities, strict protection, smooth circulation, and effective supervision，To realize the overall protection, intensive utilization and systematic restoration of natural resources，It provides a strong guarantee for food security, ecological security and resource security in our province。

Ii. Main tasks

　1. Improving the property rights system for natural resource assets

　　1.We will build a property rights system for natural resource assets with scientific classification and complete content。Actively promote the separation of ownership and use rights of natural resource assets。Carry out research on the forms of national ownership of natural resource assets, and innovate the forms of national ownership and collective ownership of natural resource assets。

　　2.Promote the separation of the rights of contracted land and residential land。We will implement the separation of ownership rights, contracting rights and management rights of rural contracted land, and guide the orderly transfer of management rights。We will steadily advance the reform of the rural housing land system and explore the separation of ownership, qualification and use rights of residential land.。

　　3.We will promote the establishment of separate use rights for construction land above, above and below ground。We will carry out studies on the use rights of construction land above, above and below ground, promote the development and utilization of three-dimensional space for construction land, incorporate the planning of underground space into national space planning, and improve the efficiency of space utilization。

　　4.Strengthen the management of mining rights transfer registration。Implement the national policy on reform of the mining right system, handle the validity period and extension period of exploration rights and mining rights in accordance with the law and regulations, carry out research on the mortgage rights of mining rights, and improve the mechanism for connecting exploration rights, mining rights and land use rights。

　　5.We will improve the right system of aquaculture in coastal areas。Straighten out the relationship between the right of aquaculture and the land contract management right, and further enrich the form of realization of the right of aquaculture。

　　6.Improve the water rights management system。Carry out special studies to straighten out the relationship between the right to draw water and the mining rights of groundwater, geothermal water and mineral water。

　　(2) Clarify the subject of property rights of natural resource assets

　　1.We will implement the entrustment and agency mechanism for the ownership of natural resource assets by the whole people。We will carry out research on the entrustment and agency mechanism for the ownership of natural resource assets owned by the whole people, and select some provincial cities to carry out pilot work。Implement the resource inventory and supervision and management system for provincial and municipal governments to exercise the ownership of natural resource assets owned by the whole people on behalf of the people。

　　3.The ownership of collectively owned natural resource assets in rural areas will be implemented。We will advance the work of determining the ownership of collectively owned natural resource assets in rural areas, implement the status of special legal persons of rural collective economic organizations in accordance with the law, and allow them to exercise the ownership of collectively owned natural resource assets on behalf of the collectives, and enhance the management and operation capacity of collectively owned natural resource assets in rural areas。

　　4.We will protect the legitimate rights and interests of players in the natural resource assets market。We will improve the market access system and market competition rules for natural resources, and protect the rights and interests of all types of market players to participate in market competition and use natural resource assets on an equal footing according to law。

　　(3) Carry out unified investigation, monitoring and evaluation of natural resources

　　1.We will improve the classification standards for natural resources and the investigation, monitoring and evaluation system。To carry out research on classification standards of natural resources, and improve the investigation, monitoring and evaluation system of natural resources in our province。

　　2.To organize and conduct surveys of natural resources。We will start the inventory of natural resource assets owned by the whole people in the province, such as land, minerals, forests, wetlands and grasslands step by step, establish a database of all types of natural resource assets owned by the whole people, and grasp the quantity, quality, distribution, ownership, protection, development and utilization of important natural resources。

　　3.We will explore ways to establish an accounting and evaluation system for natural resource assets owned by the whole people。To carry out the statistics of the physical quantity of natural resource assets owned by the whole people, explore the accounting of the value volume, and compile the balance sheet of natural resources owned by the whole people in our province。By the end of 2021, we will formulate a method for compiling the balance sheet of natural resources owned by the whole people, and select some localities to carry out pilot projects for the inventory and preparation of natural resources assets owned by the whole people。

　　4.Carry out dynamic monitoring of natural resources。Carry out dynamic remote sensing monitoring of natural resources, and accurately grasp the changes of various natural resources in key regions of the province。Establish a unified and authoritative information release mechanism for natural resources investigation, monitoring and evaluation, and realize data sharing and integrated application of investigation and monitoring results。

　　4. Accelerating the registration of rights to natural resources

　　1.The registration of rights to natural resources shall be carried out。In accordance with the requirements of the State, cooperate with the state to directly exercise the ownership of natural resources registration。To carry out the unified registration of the right of natural resources to exercise ownership by agents in our province。By the end of 2022, we will basically complete the unified identification and registration of natural resources in key regions of the province;By the end of 2025, the whole province will be covered by the registration of natural resources。

　　2.Strengthen the management of rights confirmation registration information。Establish the provincial natural resource ownership registration database, and improve the management ability of natural resource ownership registration information。We will improve the information disclosure system for natural resource property rights, and realize inter-departmental data sharing by relying on the provincial government data sharing and exchange platform。

　　5. Strengthening the overall protection of natural resources

　　1.We will strengthen the link between territorial planning and resource protection。We will complete the formulation of territorial and spatial plans at all levels, and scientifically delineate and strictly observe the three lines of control, namely, the red line for ecological protection, the boundary for permanent basic farmland, and the boundary for urban development。We will improve the planning management mechanism and strengthen the linkage between planning implementation and the property rights system and management policies。Select some localities to carry out pilot programs for the protection and use of natural resource assets owned by the whole people。

　　2.Strengthen control over the use of natural ecological space。Implement unified control over the province's territorial space, strengthen use control, and strictly implement use control rules, industrial access policies and negative lists。We will establish a sound control system for the use of natural ecological space, and strengthen the overall protection of mountains, rivers, forests, fields, lakes, grasses and sand。

　　3.We will strengthen the management of property rights in protected natural areas。We will conscientiously implement the system of protected natural areas with national parks as the main body, improve the system of concession rights for natural resource assets in protected natural areas, and promote the reasonable withdrawal and classified disposal of exploration rights, mining rights, water extraction rights, beach farming rights and concession rights in protected natural areas in accordance with the law。

　　4.We will explore mechanisms to realize the value of ecological products and compensate for multiple ecological protection。Explore the establishment of a multi-value realization mechanism based on the value accounting of ecological products, and build an ecological economic system with industrial ecology and ecological industrialization as the main body。Explore ways to expand natural ecological space through leasing, replacement and purchase。We will encourage the use of market-based compensation methods such as emission rights, water rights, and energy rights trading, and implement a national carbon emission offset mechanism。Work with relevant provinces to carry out research and pilot work on the value realization mechanism of ecological products in Danjiangkou Reservoir area of the Middle Route of the South-to-North Water Transfer Project, and explore the establishment of cross-provincial cooperation mechanisms。

　　5.Establish and improve mechanisms for compensation and accountability for damage to natural resource assets。Carry out research on the types, subjects, forms and contents of damage to natural resource assets, and gradually establish a system for discovery, correction, compensation and accountability of cases of damage to natural resource assets。

　　6. Promoting the intensive development and utilization of natural resources and assets

　　1.We will advance reform of the system for the paid use of natural resource assets owned by the whole people。To formulate the access conditions, acquisition methods and procedures for the paid use of natural resource assets in our province。We will study and introduce a reform plan for the paid use system of state-owned forest resources。Competitive transfer of mining rights shall be carried out。Implement unified allocation, total volume control and hierarchical supervision of water resources and hydropower resources development and utilization in river basins。

　　2.We will explore ways to establish a grading and grading price evaluation system for natural resource assets。We will improve the grading and grading system for urban and rural land prices, and carry out dynamic monitoring of urban land prices。We will explore ways to formulate detailed rules and technical guidelines for the price assessment of natural resource assets, and gradually establish a grading system for all types of natural resource assets。

　　3.We will improve the standard system for the development and utilization of natural resource assets and industrial access policies。We will study and establish local standards for the development and utilization of natural resource assets, improve standards for various types of industrial land and industrial access policies for the development and utilization of natural resource assets, and vigorously promote the transfer of "standard land" for industrial land。The level of exploitation and utilization of natural resource assets and the requirements of ecological protection should be taken as important factors in selecting the right holder, and included in the natural resource asset transfer contract。

　　4.We will establish a market-based operation mechanism for natural resource assets。We will build a platform for trading natural resource assets and property rights, improve the market service system, improve the market monitoring, supervision and regulation mechanism, and increase the types of trading of ecological products。We will improve rules for the transfer, leasing and mortgage of the right to use natural resource assets。We will explore the establishment of a credit system for natural resource assets market。

　　7. Promoting restoration and reasonable compensation for the natural ecological space system

　　1.We will improve the system restoration and comprehensive management of mountains, rivers, forests, fields, lakes, grass, and sand。We completed the drafting of provincial-level master plans for ecological restoration of territorial space, and carried out the drafting of special plans for major projects to protect and restore important ecosystems in the Yellow River, Yangtze River, Huaihe River and Haihe River basins and the Taihang Mountain, Dabie Mountain and Funiu Mountain。We will accelerate the ecological protection and restoration of mountains, rivers, forests, fields, lakes, grass and sand in important ecological functional areas。

　　2.We will explore ways to establish a compensation mechanism for the use of ecological space。Adhere to the principle of "who occupies, who compensates", establish and improve the occupation compensation system for the occupation of various types of natural ecological space and overlaid minerals in accordance with the law, strictly occupy conditions, and implement compensation standards。

　　3.We will implement a compensation system for ecological and environmental damage。Adhere to the principle of "whoever damages, whoever pays", and establish a compensation mechanism for ecological and environmental damage with clear responsibilities, smooth channels, adequate compensation, and effective restoration in accordance with the law, and the responsible person shall bear the responsibility for restoration or compensation。Where the responsible person is lost, the government at all levels shall organize the restoration work in accordance with the principle of territorial management。

　　4.Encourage social investors to engage in ecological protection and restoration。Adhere to the principle of "who restores, who benefits", and attract social capital to participate in ecological restoration projects through measures such as granting natural resource assets the right to use for a certain period of time。

　　8. Improve the natural resource assets supervision system

　　1.We will improve the supervision mechanism for natural resource assets。We will give full play to the roles of the people's Congress, the administration, the judiciary, auditing and public oversight to achieve dynamic and effective oversight of the development, utilization and protection of natural resource assets throughout the process。Integrate natural resource elements and management data such as land, minerals, surveying and mapping, geology, forests, grasslands, wetlands, and water resources, build a unified big data comprehensive management system for natural resource assets in the province, and comprehensively improve supervision and management efficiency。

　　2.Establish a working mechanism for reporting state-owned natural resource assets。Governments at all levels shall, as required, report to the Standing committees of the People's congresses at the corresponding levels on state-owned natural resource assets。Natural resource departments at all levels shall regularly report to the governments at the corresponding levels on the management of state-owned natural resource assets。

　　3.Explore the establishment of a natural resource asset management assessment system。We will audit leading officials' natural resource assets when they leave office, and implement a system of holding party and government leading officials accountable for damage to their natural resource assets。

　　4.Strengthen law enforcement of natural resource assets。Promote the establishment of a seamless mechanism for natural resources administrative law enforcement, administrative prosecution, and criminal law enforcement to achieve efficient and smooth information sharing, case reporting, and case transfer。We will actively carry out pilot projects to enforce the "separation of executive and executive duties" on illegal land occupied by natural resources, improve the law enforcement system for natural resources assets, and seriously investigate and punish illegal and criminal cases in the property rights field of natural resources assets。

　　9. Improving the legal system of natural resource property rights

　　1.We will strengthen the rule of law in natural resources。We will earnestly implement national laws and regulations on the property rights of natural resource assets, and promptly study and introduce supporting policies。We will strengthen legislative research and personnel training related to the reform of the natural resource property rights system, and support relevant universities in setting up disciplines related to natural resource property rights。

　　2.To handle all types of natural resource property rights cases according to law。We will establish a sound property rights dispute resolution mechanism for natural resources。We will fully implement legal systems such as public interest litigation and ecological and environmental damage compensation litigation, and establish a mechanism for coordinating civil, administrative and criminal trials of natural resource property rights。Timely release typical cases of serious infringement of property rights of natural resource assets。

Third, safeguards

　　1. Strengthen organizational leadership。The relevant departments of all localities shall strengthen the organization and leadership of the reform of the property rights system of natural resources assets, formulate schedules and road maps in accordance with the requirements of this implementation plan and in light of the actual situation, decompose and implement various tasks, and ensure the orderly progress of the reform and its effective implementation。

Strengthening overall planning and coordination。The relevant departments of the provincial government should fulfill their responsibilities, cooperate closely, and coordinate the establishment of the policy system and the formulation of supporting measures, the decomposition of objectives and tasks, and the guarantee of funds。All localities should adapt to local conditions, actively carry out beneficial exploration, and form a work pattern of top-down linkage, departmental coordination, and joint management。

　　3. Strengthen publicity and guidance。Strengthen the interpretation of policies, widely publicize the significance, basic ideas and key tasks of the reform of the natural resource asset property rights system, make full use of important anniversaries such as Earth Day, World Water Day and National Land Day, carry out various forms of publicity activities, and create a good public opinion atmosphere。
